Here, I presented the above-mentioned article. In brief, the said article takes a closer look at instances which buttress the inefficacy of voluntary due diligence measures. Its aim is to re-establish the necessity of mandatory due diligence measures such as the CSDDD and other similar mandatory rules via analyzing (the inefficacy of) existing voluntary due diligence mechanisms. To do this, I evaluate evidence from relevant studies, jurisprudence and OECD case law for the past twenty years.
