This presentation analyzed refugee exclusion practices where allegations of terrorism or terrorist-related offences arose, to explore refugee law’s increased concern for transnational crime. It positioned refugee exclusion within the crimmigration thesis, which posits that the apparatus of the state is used to expel from society those deemed ‘criminally alien’, resulting in an ever-expanding population of ‘the excluded and the alienated’. These ideas are starkly seen in the refugee exclusion determination process, as Article 1F is one important means through which the threat to the state can be managed. Focusing on exclusion decisions grounded on the suspicion of terrorism, the manner in which states balance national security concerns and humanitarian considerations was explored, by examining the language and logic used in exclusion jurisprudence where terrorist-related conduct is suspected.
