The Diffusion of Criminal Law into Refugee Law: cause for concern or a necessary evil?

As the reach of international criminal law has grown, this growth has been diffused directly into the interpretation of the exclusion provision of the 1951 Convention. This diffusion is to a certain extent by design, as envisaged by the authors of the 1951 Convention. Unfettered diffusion may be cause for concern, however, as the borderlines between criminal law and refugee law continue to change. This paper will explore to what extent the legal diffusion of criminal law into refugee law should be cause for concern, in particular how criminal justice language and logic in refugee jurisprudence has the potential to distort the humanitarian underpinnings of refugee law.
