Blockchain and data protection: An uneasy fit

Abstract

From a data protection perspective blockchain as a technology (BC) is a dual edged sword. It can both increase and decrease privacy protection. It can increase protection, e.g., by facilitating decentralized identity management and allowing the sharing of data with trusted third parties only. The inherent transparency and immutability of a public BC, however, does not sit well with principles of data confidentiality, data minimization, data accuracy and the rights of individuals to correction and deletion of their data. This chapter will discuss the legal discourse around BC which has proven a rare rollercoaster of quickly changing and diametrically opposite legal analysis
