Abstract
The creation of the European Labour Authority is an effort to enhance the control and enforcement of the working conditions of migrant labour that cross borders in the EU. This contribution reflects on some of the shortcomings from the start, both in terms of the formulated competences of ELA and in terms of the missing link with other, sometimes more determining, policy areas in the internal market, such as the freedom of establishment and the free service provision with posted workers. This is especially relevant for third-country nationals that are recruited for work inside the EU.
