Abstract
De structuurregeling is ondernemingsvorm neutraal zodat die ook van toepassing kan zijn op semipublieke organisaties. De vraag rijst dan of semi-publieke organisaties van de structuurregeling volledig of gedeeltelijk vrijgesteld kunnen worden door gebruik te maken van de in de structuur-regeling opgenomen vrijstellingen. Dit speelt met name als de semi-publieke organisatie is georganiseerd als concern. Ook bestaat onder omstandigheden de mogelijkheid gebruik te maken van het verzwakte regime respectievelijk van een vrijwillige toepassing. Indien het structuurregime van toepassing is, rijst de vraag naar de inhoudelijke samenloop van de verplichting tot inrichting van het toezicht volgens de dwingendrechtelijke structuurregeling met de verplichtingen die voortvloeien uit de sectorale toezichtmodellen voor semipublieke organisaties.
