Reviews the development of Dutch company insolvency law and its key features. Examines the requirements for a bankruptcy petition, the main participants, the treatment of a bankrupt's estate and of executory contracts, and the order of distribution. Details the position of secured creditors and pre-insolvency creditors, the role of set-off, the requirements for showing fraudulent preference, and the conduct of restructuring proceedings.
