Abstract
The intensification of migratory flows towards the West, coupled with processes of economic integration, necessitates an imperative structured engagement with the Islamic world. The burgeoning population adhering to the Islamic faith underscores the need for the formulation of institutional policies capable of managing the dynamics precipitated by this phenomenon. The principles rooted in Western legal culture serve as the primary grounds for engagement with Islamic communities, which, endowed with significant expansive force, challenge the typically Western ethnocentrism while safeguarding indispensable religious and cultural traditions.The right to cultural identity, even when it pertains to a minority, plays a pivotal role in the formation and development of an individual's personality. Starting from the acknowledgment of minority rights at international, supranational, and national levels, the issue of identity concerns has resurfaced at the forefront of public discourse, particularly concerning the Islamic minority.This volume aims to address one of the most debated issues on the subject: the overlap between cultural and religious identity that characterises this minority, in relation to which the exercise of jurisdiction highlights the coexistence of religious and secular rules that require the use of tools and mechanisms for the reasonable accommodation of differences.
