Abstract
Though the existence of works councils seems to be well recognised in Germany the compliance with the works council act is low as many small companies have no works council installed. In a contribution to the Dutch quarterly Zeggenschap Jan Cremers (AIAS) concludes, after reading the first analysis of the recent works council elections, that the effort of the German government to improve the compliance by a revision of the legal frame in 2001 has failed.
