Abstract

The year 2022 witnessed significant developments for European Standardisation - in February, the European Commission published its Standardisation Strategy, and by December, an amendment to the Regulation (EU) No 1025/ 2012 was adopted by the European Parliament and the Council (applicable in July 2023). Whilst the Strategy calls upon the three European Standards Organisations (ESOs) to modernise their governance and decision-making, the Amendment requires ESOs to ensure that decisions related to European standards and standardisation deliverables be exclusively undertaken by the representatives of national standardisation bodies (NSBs) from Member States and EEA countries. Since ETSI relies on a direct participation model (in contrast to the national delegation model as practiced within the other two ESOs), these developments necessitate ETSI to undertake the required changes to its institutional design and procedures, and in the process drawing scrutiny from the EC, its membership, and external commentators. This paper delves into the historical contexts and environs under which ETSI was established to provide an account of ETSI’s arrival at the institutional design choices for its two key differentiators - the direct participation model and the atypical involvement of NSBs within ETSI.
