Abstract
Whilst there is undeniably a trend in the Court of Justice's intra-EU mobility case law that justifies criticism that is is more receptive to Member State interests, this is not the full story. This contribution aim is to show that, at the same time, that court is using the principle of proportionality to protect individual interest.
