Relying on digital principles to complement existing rights: A human rights assessment of the 2022 European Declaration on Digital Rights and Principles

Abstract

This chapter examines whether the EU should adopt a firmer and more ambitious approach in terms of legal protection of individuals’ interests in the digital by means of new digital rights codification. A normative approach based on new rights in the digital aligns more coherently with the agenda of new digital rights proponents, including the European Parliament, that have gained argumentative power in recent years. The progressive EU digital agenda leans in favor of such an approach. To answer this question, we review human rights scholarship to assess arguments in support and against the codification of new (digital) rights.
