Abstract
Climate change litigation booms across many jurisdictions and puts the interplay between legal and scientific questions in the limelight. But how do courts tackle the scientific aspects in cases where the plaintiffs argue a governmental failure to mitigate emissions? Are judges actively integrating scientific knowledge into their decision-making? A content analysis of case law in 15 jurisdictions shows that courts often shy away from expert aid.
