Abstract
Examines the growth of sukuk in Islamic finance, and the main challenges it faces. Discusses the problems surrounding the legal enforceability of Sharia-compliant measures, highlighting the extent to which sukuk is recognised as a financial instrument, the approach of courts in jurisdictions including the UK, and key features of the Sharia framework for sukuk structures. Considers how liaison between lawyers and Sharia scholars might be improved.
